Pinch'n Pennies Release and Waiver of Liability

PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

 

This Release and Waiver of Liability (the "Release") executed on this ____day of ________, 20__, by ____ (the "Volunteer") in favor of Pinch'n Pennies LLC, a for-profit corporation, and its directors officers, employees, and agents.

 

The Volunteer desires to work as a volunteer for Pinch'n Pennies LLC and engage in the activities related to being a volunteer for Serve Us Saturdays (the "Activities"). The Volunteer understands that the Activities may include:

 

Food Distribution – Serving (Onsite/Mobile)   Participants may lift, carry, and transport boxes or bags of food weighing up to 40 lbs. Activities may occur indoors or outdoors and may involve exposure to heat, cold, rain, uneven surfaces, moving vehicles, and crowds. Risks include slips, falls, strains, and minor injuries from handling supplies.

 

Sorting/Packaging   Volunteers may stand for extended periods, lift and stack items, use basic tools, and organize materials. Hazards include repetitive-motion strain, contact with sharp objects such as box cutters, and minor injuries from lifting or sorting.

 

Speaking or Teaching a Workshop/Class   Participants may set up tables, chairs, or equipment, which may involve light lifting. Hazards include tripping over cords or equipment, navigating crowded spaces, or minor strains from room setup.

 

Administrative Support   Participants engage in office tasks that may include lifting small office items, filing, or moving supplies. Risks include minor strains, trips or falls, and exposure to normal office hazards.

 

Social Media Advocate   Minimal physical labor; may include attending events for photos or videos. Hazards may include crowd environments, uneven outdoor terrain, or light lifting of equipment.

 

Fundraising for the Southside Community   Activities may occur indoors or outdoors and may include event setup, canvassing, or carrying supplies. Risks include exposure to weather, prolonged standing or walking, and minor lifting-related injuries.

 

Cleaning, Decorating, or Restoring the Pinch'n Pennies Building & Landscape   Participants may lift, carry, bend, sweep, paint, or move furniture and equipment. Outdoor work may include clearing debris, gardening, or basic landscaping. Hazards include exposure to chemicals, sharp tools, ladders, uneven ground, heavy items, and weather-related conditions.

 

Mentoring   Participants may meet with youth or adults in various indoor or outdoor settings. Hazards are minimal but may include navigating unfamiliar environments or school campuses.

 

Age ranges the participant is interested in mentoring: Middle School, High School, College, Adult

 

Cleaning or Clearing/Removal (Indoor or Outdoor – Residential or Commercial)   Activities may include lifting heavy items, moving furniture, removing debris, sweeping, hauling trash, and using basic tools. Hazards include exposure to dust, allergens, chemicals, sharp or broken materials, and uneven or cluttered spaces. Outdoor work may involve weather exposure, insects, or yard debris.

 

Renovation or Restoration (Indoor or Outdoor – Residential or Commercial)   Participants may be exposed to construction-like environments involving lifting, cutting, painting, sanding, using tools, and handling building materials. Hazards include power tools, ladders, dust, loud noises, heavy objects, and hazardous or uneven surfaces.

 

Animal Care   Participants may groom, wash, feed, or water animals, including cats, dogs, domestic pets, farm animals, or zoo-type animals depending on the assignment. Hazards may include bites, scratches, exposure to animal waste, slipping on wet surfaces, lifting animal crates or feed bags, and unpredictable animal behavior.

 

The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:

 

1. Release and Waiver. Volunteer does hereby release and forever discharge and hold harmless Pinch'n Pennies LLC and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise or may hereafter arise from Volunteer's Activities with Pinch'n Pennies LLC .

 

VOLUNTEER UNDERSTANDS THAT THIS RELEASE DISCHARGES PINCH'N PENNIES LLC FROM ANY LIABILITY OR CLAIM THAT THE VOLUNTEER MAY HAVE AGAINST PINCH'N PENNIES LLC WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM VOLUNTEER'S ACTIVITIES WITH PINCH'N PENNIES LLC, WHETHER CAUSED BY THE NEGLIGENCE OF PINCH'N PENNIES LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS OR OTHERWISE. VOLUNTEER ALSO UNDERSTANDS THAT PINCH'N PENNIES LLC DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.

 

2. Medical Treatment. Volunteer does hereby release and forever discharge Pinch'n Pennies LLC from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer's Activities with Pinch'n Pennies LLC .

 

3. Assumption of the Risk. The Volunteer understands that the Activities may involve work that may be hazardous to the Volunteer, including, but not limited to, Food Distribution, Sorting/Packaging, Speaking or Teaching a Workshop/Class, Administrative Support, Social Media Advocate, Fundraising or the Southside Community, Cleaning, Decorating, or Restoring the Pinch'n Pennies Building & Landscape, Mentoring youth or Adults, Cleaning or Clearing/Removal, Renovation or Restoration, Animal Care, and transportation to and from the work sites. Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities, and releases Pinch'n Pennies LLC from all liability for injury, illness, death, or property damage resulting from the Activities.

 

4. Insurance. The Volunteer understands that, except as otherwise agreed to by Pinch'n Pennies LLC in writing, Pinch'n Pennies LLC does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.

 

5. Photographic Release. Volunteer does hereby grant and convey unto Pinch'n Pennies LLC all right, title, and interest in any and all photographic images and video or audio recordings made by Pinch'n Pennies LLC during the Volunteer's Activities with Pinch'n Pennies LLC, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

 

6. Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. Volunteer also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
